Terms of Service

These Terms of Service (“Terms”) govern your use of services provided by Horizon HVAC LLC, a Rhode Island-licensed HVAC contractor (License #00007430). By scheduling service, requesting a quote, submitting a form on our website, or receiving SMS communications from us, you agree to these Terms.

Services We Provide

Horizon HVAC LLC provides heating, ventilation, and air conditioning services to residential and commercial customers in Rhode Island, including:

  • Service and repair of AC systems, furnaces, boilers, heat pumps, and ductless mini-splits
  • New installation of HVAC equipment
  • Preventive maintenance and tune-ups
  • Comfort Club membership (recurring maintenance plan)
  • Clean Heat RI and Mass Save rebate-eligible heat pump installations
  • 24/7 emergency dispatch

All work is performed by licensed and insured technicians.

SMS Communications — What to Expect

When you provide your phone number and opt in to SMS, you may receive the following types of messages:

Transactional SMS (requires consent to receive service):

  • Service request confirmations
  • Appointment scheduling and rescheduling
  • Dispatch updates (technician assigned, en route, arrived)
  • Service completion and follow-up
  • Quote delivery and review requests
  • Payment receipts and billing notices

Message frequency: Varies based on your active service requests, typically 2-6 messages per service call.

Marketing SMS (optional, separate consent required):

  • Seasonal tune-up reminders (spring and fall)
  • Comfort Club membership offers and renewals
  • Clean Heat RI and Mass Save rebate updates
  • Service specials and limited-time promotions

Message frequency: Up to 4 marketing messages per month if subscribed.

Cost: Message and data rates may apply. Standard rates from your mobile carrier may apply to SMS messages we send and any replies you send. Horizon HVAC does not charge for sending or receiving SMS.

Opt-Out Instructions

You can opt out of SMS communications at any time:

  • Reply STOP to any message from Horizon HVAC to unsubscribe from all SMS from that number. You will receive one final confirmation message.
  • Reply HELP to any message for assistance.
  • Email support@horizonhvacinc.com requesting removal.
  • Call (401) 425-9879 during business hours and ask to be removed.

We process opt-out requests within 24 hours. Opting out of marketing SMS does not opt you out of transactional SMS for active service requests. To stop all SMS including transactional messages, reply STOP or contact us directly.

Scheduling and Service

  • Estimates and quotes: Provided in writing before any work begins. All pricing is flat-rate unless specifically noted otherwise. We do not charge hourly for residential service work.
  • Diagnostic fee: $50 for in-home diagnostics, waived if you approve the recommended repair the same day.
  • Service windows: When you book a service call, our office will contact you to schedule a window based on real dispatch availability.
  • Cancellation: Please give us at least 24 hours notice. Same-day cancellations may incur a $50 trip fee if the technician has already been dispatched.
  • Emergency dispatch: Available 24/7 at (401) 425-9879. Emergency rates may apply for after-hours service.

Payment Terms

  • Payment is due upon completion of service unless otherwise agreed in writing.
  • We accept major credit cards, debit cards, ACH, and check.
  • Comfort Club memberships are billed monthly via auto-pay on the payment method on file.
  • Past-due balances accrue interest at 1.5% per month after 30 days.
  • Returned check fee: $35.

Warranties

  • Labor warranty: Repair labor warranted for 90 days from completion.
  • Installation warranty: 1-year labor warranty from Horizon HVAC plus the manufacturer’s parts warranty (typically 5-10 years).
  • Comfort Club members: 15% off all repairs and an extended labor warranty.
  • Warranty does not cover damage from misuse, neglect, unauthorized modification, or normal wear-and-tear.

Customer Responsibilities

You agree to provide accurate contact information and service address, be available or have an authorized adult present during scheduled service, provide reasonable access to the equipment, pay for completed services per the agreed terms, and notify us promptly of any warranty concerns.

Privacy

Our handling of your personal information is governed by our Privacy Policy. By using our services, you agree to those practices.

Limitation of Liability

To the maximum extent permitted by Rhode Island law, Horizon HVAC’s total liability for any claim arising from a service is limited to the amount paid for that service. We are not liable for indirect, incidental, consequential, or punitive damages. This limitation does not apply to bodily injury, gross negligence, or willful misconduct.

Disputes

If a dispute arises, contact us first at (401) 425-9879 or support@horizonhvacinc.com. If we cannot resolve the dispute, both parties agree to attempt mediation in good faith before pursuing litigation. Any litigation will be brought in the courts of Rhode Island and governed by Rhode Island law.

CARRIER LIABILITY

Wireless carriers, including but not limited to AT&T, T-Mobile, Verizon,
Sprint, and U.S. Cellular, are not liable for delayed or undelivered
messages. Message and data rates may apply. Message frequency varies.
Carriers are not responsible for any issues related to the transmission
or receipt of messages from Horizon HVAC Inc.

AGE RESTRICTION

You must be at least 18 years of age to use this service and to consent
to receive text messages from Horizon HVAC Inc. By submitting any form or
opting in to communications, you confirm you are 18 years or older and
have the legal authority to enter this agreement.

Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date reflects the most recent revision. Continued use of our services after a change constitutes acceptance.
